Terms and conditions

Duet advocaten is a private limited company organized under Dutch law.

These terms and conditions apply to all services provided and to be provided (including additional assignments and subsequent assignments) by Duet advocaten, unless agreed otherwise in writing prior to engagement. The applicability of any terms and conditions of clients is explicitly dismissed.

All assignments are accepted and executed by Duet advocaten exclusively under a contract of engagement, even if it is the explicit or implicit intention that an assignment will be executed by an individual partner and/or director of a partner and/or a colleague employed by Duet advocaten. The applicability of Sections 7:404 and 7:407, subsection 2 of the Dutch Civil Code is hereby excluded.

The provisions contained in these terms and conditions can be invoked not only by the company, but also by an individual partner and/or a director of a partner and/or a person employed or previously employed by Duet advocaten.

In the execution of its assignments, Duet advocaten will act with due care and attention.

In the event that the execution of an assignment by Duet advocaten results in liability, such liability is limited to the amount that is paid out under the applicable professional indemnity insurance of Duet advocaten in the relevant case, plus the amount of the excess payable by Duet advocaten under the applicable policy conditions. A copy of the applicable policy conditions is available on request.

When engaging third parties, Duet advocaten will act with due care and attention. Costs in relation to engaging third parties will be charged to the client. Any liability of Duet advocaten for shortcomings by these third parties is excluded. Insofar as third parties limit their liability for professional errors, Duet advocaten is entitled to accept such a limitation of liability on behalf of its clients.

The services provided by Duet advocaten are subject to the Duet advocaten office complaints procedure. This procedure can be consulted at www.duetadvocaten.nl and will be provided on request.

Duet advocaten invoices its services on a monthly basis. Invoices must be paid within 30 days of the invoice date, without suspension or set-off.

Duet advocaten has the right to review its fees on the 1st of January of each year. Duet advocaten will inform the client in advance of any adjustments.

The legal relationship between the client and Duet advocaten is governed by Dutch law. Disputes arising from the legal relationship between the client and Duet advocaten may be submitted to the Dutch court exclusively.

In the event of conflicts between the Dutch text and the English translation of these terms and conditions, the former will prevail.
